Please read these terms and conditions carefully before using Messagea services, applications, and web platform.

Important Agreement Summary

By accessing or using Messagea, you enter into a legally binding agreement to follow our acceptable use rules, maintain account security, and respect intellectual property rights. If you do not agree to these terms, you may not access or use Messagea.

Section 1

1. Acceptance of Terms & Eligibility

These Terms of Service ("Terms") govern your access to and use of Messagea ("Service"), operated by Messagea Inc. By creating an account, downloading our applications, or using our messaging platform, you confirm that you are at least 13 years of age (or minimum legal consent age in your country) and possess full legal authority to enter into these Terms.

Section 2

2. Account Registration & Security Responsibilities

To use Messagea, you must register using a valid phone number or email address. You are responsible for:

  • Credential Confidentiality: Maintaining the security of your authentication tokens, SMS verification codes, and two-factor credentials.
  • Account Activity: All actions, communications, and media transmitted through your registered account.
  • Immediate Notification: Notifying security@messagea.com immediately if you suspect unauthorized access to your account.

3. Acceptable Use Policy & Prohibited Conduct

You agree to use Messagea solely for lawful purposes. You are strictly prohibited from engaging in any of the following activities:

Spam & Automated Messaging

Sending unsolicited bulk messages, automated bot broadcasts, or promotional spam.

Malicious Attacks

Distributing malware, viruses, phishing links, or attempting to breach platform infrastructure.

Harassment & Abuse

Stalking, harassing, threatening, or impersonating other individuals or entities.

Reverse Engineering

Attempting to decompile, reverse engineer, or extract source code from client applications.

Section 4

4. Intellectual Property & License Grant

Service Rights: Messagea, its brand assets, UI designs, codebases, and trade dress are the exclusive property of Messagea Inc. We grant you a limited, non-exclusive, non-transferable, revocable license to use our client software.

Your Content Rights: You retain full ownership of the messages, files, and media you send through Messagea. Because messages are end-to-end encrypted, Messagea claims no copyright or license over your personal communications.

5. Service Availability, Updates & Modifications

We continuously improve Messagea by adding features, pushing security patches, and refining server capacity. While we target 99.9% service uptime, Messagea does not guarantee uninterrupted service and reserves the right to modify or temporarily suspend features for scheduled maintenance.

6. Disclaimers & Limitation of Liability

AS-IS BASIS: MESSAGEA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

MAXIMUM LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, MESSAGEA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR BUSINESS INTERRUPTION.

7. Account Termination & Suspension

You may close your account at any time via the account settings menu. Messagea reserves the right to suspend or terminate accounts that breach our Acceptable Use Policy or present security risks to the network.

Section 8

8. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with applicable state and federal laws without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through binding individual arbitration or small claims court.
